What must a Canadian ghostwriting contract say about ownership?

A Canadian ghostwriting contract should identify the writer’s initial authorship, assign copyright in writing, address moral-rights waiver separately, and state whether credit or royalties are owed. It should also define NDA coverage, source ownership, permitted subcontractors, backup retention, deletion timing and the files delivered when the final milestone is accepted.

Written copyright assignment

Canada’s Copyright Act generally makes the author the first owner and requires an assignment to be written and signed. “Work for hire” is US shorthand; we do not rely on that label alone for an independent contractor.

Separate moral-rights language

Moral rights cannot be assigned in Canada, but they may be waived. A copyright assignment does not itself waive them, so the agreement must treat the two concepts separately.

Credit and royalties

The contract should say whether the ghostwriter is uncredited and whether the fixed fee replaces any royalty claim. Publishing income, subsidiary rights and permitted portfolio use should not be left to assumption.
